Under the 1987 Philippine constitution The Philippine Government has provided a doctrine on separation of power that aims to restrict the government's abuse of power using the three branches of the government: The executive, legislative and the judiciary. The roles of these three branches were also written in 1987 Philippine Constitution articles VI ,VII and VIII. Where in article VI legislative department, the power is given to the congress that is composed of twenty-four senators that was elected by the majority of the citizens and two hundred fifty house of representatives that are elected from the provinces and the cities, their role is to create, change, and amend the laws.
The article VII executive department is composed of the president as the head of the department, vice president and the cabinet members , the role of the executive department is to execute the laws. The Article VIII Judicial Department where in the power is given to the supreme court or the highest court and the lower courts they are responsible to examine the law whether it is constitutional and unconstitutional and resolve issues regarding human rights through the use of legal measures. However, to prevent the abuse of power and ensure that there will be no superior departments over the other, there is the constitution's provision of check and balances.
In addition, the check and balances work on making the bill into a law that will create an interrelationship between the three branches. For instance, the legislative cannot make laws all they want, it will still undergo with the different departments before it will be implemented, where judiciary will examine whether this law is appropriate base from the constitution and the executive will sign the law in order for it to be implemented in the society or use the veto to reject laws.
The existence of the three branches will help ensure that the government's power are equally distributed. The three branches of the government give function to the democracy to become stable and effective. Where people can experience liberty and fairness through the protection of human rights and the prevention of the abuse of power.
In conclusion, the Philippine constitution now adds to the law to give an order for all citizens to follow the said constitution of the Philippines for the good of our society. This constitution of the Philippines would help to fight our rights as, humans. To not able to harm individually without a right to fight.
