Regulatory Bodies And Authorities In Sport

The Health and Safety Executive (HSE) is the person responsible for the encouragement, regulation and enforcement of workplace and the health, safety and welfare of others during work in Great Britain. The HSE was created by the Health and Safety at work act (1974) and has grown much bigger since. The HSE observers’ industrial incidents, small and large, some minor but some major such as an explosion of a fire, they also prevent work-related death, injury and ill health. An example of this is during the cleaning of toilets in sports centers there needs to be a sign put up letting the public know the ‘floor is wet/being cleaned’, this will stop large injures from happening if someone happened to slip due to there being no sign up.

A national governing body (NGB) is typically an independent, self-appointed organisation through the consent of sport. The NGB’s have a specific role and function, for example they can include a disciplinary action for rule breaking and deciding on a rule change in the sport that they govern. Governing bodies have different roles; they may cover a range of sport at international level, such as Olympics and the Paralympics, or can be involved in a single sport at a national level, such as Rugby League. Every sport has a different governing body that helps that sport operate through different clubs; this is due to sports having different levels of skills and difficulty so everyone is organised to play their sport by ability and age. There are many different sport governing bodies, one example is, international sports federations they are responsible for one sport. They are the creators of a set of rules and generally help to organise international competitions. They also help to promote the sport. An example of this would be during aquatics (water sports) or during skiing.

The Adventure activities licensing authority (AALA) has an aim to provide assurances to the public about the safety of those activity providers who have been given a license. Young people are expected to be able to continue and enjoy exciting and challenging outdoor activities without being exposed to harm like risks of death or disabling injury. A license indicates that providers have been examined by an Adventure Activities Licensing Authority, specifically playing attention to the managements of young people. AALA was made after the Lyme Bay canoeing accident in March, 1993 which involved an organisation assuming the responsibility for children’s safety. A group of eight children, their teacher and two instructors from an outdoor center got into a dangerous situation in the water, resulting in four of the eight teenagers drowning. One of the parents of the children fought in court for the independent licensing authority to become a reality to save many others lives. This would apply to the sporting industry by during rock climbing outside, ensuring that as well as the participants fully enjoying the sport they are also strapped on properly and are not at any risk of injury.

Local Educations Authorities these are the local councils in England and Wales with responsibilities for education. Local authorities ensure every child in education have an access to ‘adequate and efficient’ education. There are many duties to make sure that children and young people get support for learning so they reach their fullest potential, a few examples include- identifying any children who need extra support, to support the child to make sure they meet their needs and having arrangements put in place if they are struggling. The LEA’s ensure every child reaches there potential and fulfils their education to the fullest. An example of this is, in the local area/ district someone will operate the local schools, such as a secondary school like Abbywood Community School will have a Local Educations Authority operative who will ensure that all children are doing the best they can, this can be shown through watching them during a sports game and a club game and comparing whether they are competing at the same effort level in both, if they are performing at less during secondary school changes will be made in order to make them reach their full potential.

The similarities between Statutory Law and Case law is that they both protect the law, meaning they will do anything they can to shield from exposure and protect citizens. They both protect people in sport, meaning they ensure that everyone is safely using equipment and they both follow the same health and safety rules meaning they must assess many risks before observing the situation. This is important as they both assess potential dangers and work to ensure they are changed if this is becoming harmful to the people, for example people using the equipment, entering a hazardous building, removing potential hazards before starting the sport. The differences are that Statutory Law it is a criminal court meaning you can face fines and imprisonment due to not following the legal rules these are often made to deter and reform, whereas the differences of a Case Law is that it is a law created by a judge and these laws are often based off of previous ones, they are put in place to prevent something from happening again.

The relationship between Loco parentis, Duty of Care and Negligence is they are all put in place to ensure there is a reasonable amount of care given to another person, this means them avoiding dangers and being given a responsibility to act as an adult towards the person. They all relate to teachers and there level of responsibility of the pupils during school trips. An example of all of them would be during a football game, helping the child if one gets hurt during a game, this would mean by removing any potential dangers and hazards, this is because without removing them or for example it is pouring down with rain and you are letting loads of younger children run/play around on the grass then one slips over due to it being slippery that would be your fault as you have not thought about the potential dangers before taking the children out onto the grass. Therefore this relationship between the 3 is very strong as they all counteract and help each other meaning when a law has been set in one its most likely to be similar in the other.

A responsible leader would act as a strong team worker demonstrating key skills to participating in a team and not allowing anyone to be left out but by including everyone. They would also have strong independent skills meaning they are resilient enough to carry their own ideas and enjoy thinking and working to themselves at times, without relying on others to do the work. They will demonstrate a positive mindset, showing the ‘I can do it’ positivity so that everyone bounces off their good energy. They will always remain happy and smiling despite if they are feeling a bit down on that day. A responsible leader will also understand different cultures and respect everyone for being an individual and if anyone is ever down or injured they will not hesitate to help them in anyway. If there is a bad injury a responsible leader will, assess the situation and help to the best of their ability for example calling an ambulance.

An irresponsible leader would be the complete opposite and not be willing to work as a team or contribute any ideas to a group. They will push themselves out of the group and will always remain quiet and unhelpful if they are needed. They will rely on other people to do the talking and always be down and inside themselves due to their lack of self confidence. An irresponsible leader will never be around to help and if there is a bad injury they will pick up an ice pack, tell them to sit out for a bit and then carry on contributing in the lesson.
