The Debate Over Consensual Sexual Relationships Between Teacher And Student
Fox News reported a story, where the child was over the age to consent and the teacher still was faulted. She was charged with improper relationships with her students. It is a new type of law that was passed in 2003, and it makes it a felony for a teacher to sleep — to have sexual relations with their students. Long story short, the jury and people argued that the young man was old enough to consent so there should not be any punishment as far as jail time towards the teacher. At 18, the child is able to go to war and is looked at as an adult so why in this case should the student be labeled as a “child”. The situation is not really a scandal for the teacher to go through so much over. On that note, a consenting relationship with another adult that he/she may be in love with does not deserve jail time. “Students and teachers should be able to engage in consensual sexual relationships.

The teacher should not receive a punishment that deep. It is understandable that it is a teacher and student affair but jail time is a way too much if the child is over the age to consent. Not to mention, the child is about to graduate so trying to stop the situation may not work. In effect to stopping it, you may push the situation to a point where there is no turning back. What is consensual sex? Is there an age limit on love? Why would a grown woman/man be imprisoned for having consent sex with someone that is lawfully an adult?

In this case, both parties are okay with having sex and nothing is forced. However, the age to consent is not the same all the way around the border. Each state may have their own age so you have to be mindful of where you at. In Louisiana and in this case, a person 17 or older can consent to have sex with a person of any age but there is a twist when you are an employee of the school system or dealing with kids. However, it should not necessarily go like that but it does so sense that makes consensual sex not even valid. A person being able to consent to a relationship so no one could be at fault would make it an advantage but in this case, it does not even make a statement and that is wrong. That is insane. The child’s consent does not even spare the teacher no time, whatsoever. What is the point of even being treated as an adult and being able to consent if the law is going to handicap you in certain situations. When you are in a criminal situation you are considered to be an adult but when you’re in a situation like a teacher-student you are considered a child? If you are treated like an adult you must be an adult all the way around the border not in certain situations. The law cannot even stop a love affair for real. If the relationship developed a strong bond and love is really there, they went be together regardless at the end of the day. So why even try to stop it by placing the “adult” in jail? It is a waste of everybody time because you cannot just kick the “child” so just fire the teacher and keep it moving. Nothing can be done in that sense to even end the situation so why put forth effort and energy to it? The child consented to the relationship so nothing happened that both parties did not agree to.
On that note, the affair probably does not even affect anyone and nobody would have even known about it. The way the situation came out should play a big part in the situation. Did it come out in a mad day? Did someone just notice it and told? How did the situation come out? A lot of people might say it does not matter how it came out but it does! You have to look at all sides to this situation in order to act on it and if the “child” comes out his/her mouth and say he/she consented then case closed. At that point, there is nothing you could about it and you need to let it go.
When you are looking at it through the eyes of the law, the teacher is considered to be more mature in the mind than the “child” so that is why the teacher is punished no matter what. However, when you are in a crime situation the “child” is considered to be an adult and fully aware of what he/she is doing or did. How does that even go like that? That is wrong on all levels. So that means the child can only be considered an adult when dealing with things politically? If by the law he or she is considered an “adult” then he or she should be treated as an “adult” is all situations. However, the world we live in today we know damn well it will not happen like that and that is all fine when you have a lawyer that is going to throw all things at court to make sure you seek your freedom and know that nothing illegal was practiced. You would have a hell of a case to fight but you can most definitely fight it because the law is not being fulfilled by the imprisonment of the teacher.
In a lot of states, having sex as a teacher with a student is not considered a crime. “If the student is a willing participant in the act, the sex between teachers and their students could be viewed as irresponsible or objectionable, but not technically illegal. ” Not saying that all states agree with this law because some states are not going for it. As a personal opinion, cities like New Orleans have a lot of broken families and unloved students. A teacher and student relationship happen a lot down here and the cases are swept under the rug. Whereas somewhere big the case might be blown up and out of proportion. Nola has a lot of broken students so teacher affection just might build a sexual relationship between the student and teacher. Do you really think you could stop it? If it really bothers the school, have the teacher and student separated on campus. A lot of cases on the topic do not even go fully through unless the student is under age and it is more of a rape situation rather than a consent situation. Love will expand as far as you allow it to go, despite the obstacles. Love does not develop off of factors such as age, race, job title, etc. It is all about the person and despite the reasons why they could not be together, they still will try.

Think about it, coming from a broken family home where you feel unloved or unwanted then going to an environment where you have an adult that shows you attention and actually cares, how would you feel? It is the psychology of the situation. The fact that your background and the way you think, feel and all the stuff you been through would inspire feelings towards someone that plays a role in your life such as your teacher. At the age of 18, most students are already sexual driven so being able to consent is just a plus one. The student probably is not even looking at the teacher as a teacher and most likely thinking about a relationship in a sexual way. Having a consensual relationship with the teacher may even take the child’s mind off all the other things.
It may not be bad for either parties and may even be good for the child’s sake. It is not like that in some cases but in some it is. In cases where it is like that, “even though teachers are in a position of power. So are many people in society. If we cannot date people in a position of power then we cannot date politicians, anyone in the army, navy, air force or emergency services. We cannot date anyone higher in position than us in our workplace. ” It is only natural, students and teachers should be allowed to engage in consensual sexual relationships and imprisonment is a step too far. When thinking about the situation, do it really matter what the teacher or student do out of school?
If the out of school relationship does not show any correlation to the school then who cares? For example, if the couple was to be seen outside of school without a corporation sign of the school or workplace then it should not be an issue with the school. On the other hand, if signs of the school was recognized in the situation then yes, that is a major issue for the school. Not being able to link to situation to any school is something the couple would most likely be pushing for. The teacher and student is aware that there is a lot on the line so anything that will jeopardize their relationship from their end of the situation is a no no. Looking at the situation one would think, “It is not no one else business, if everyone mind they business then it would not be a big deal.” However it is really not nobody business, especially if the school cannot be negatively impacted by the situation. Sometimes it is good to just stay out of people’s business and if the student was being negatively affected by the situation, the student will tell. If the situation is not harming the child mentally or physically then let it be. In this type of situation you have to look at all parties feelings in this and not just public eye. In most cases all they really care about is public eye and not all cases involving student and teacher relationships end the same way. Most people receive more jail time than others and some receive none at all.
Strategically some say, the end result of the case depends on if the teacher is male or female. Male intentions are highly sexual when compared to female intentions. However, in some cases you may have a female that is more sexually involved than the male. In other words, the female in the situation is likely to fall harder and catch feelings faster than the male and it may end badly but a male teacher and student relationship will always look badder publicly. “Young girls are taught early that it is inappropriate for men to have sexual contact with them. Young boys are sometimes taught that it is inappropriate for men to have sexual contact with them, but they are rarely taught that it is inappropriate for women to do so. ” Why would a relationship with a female teachers a male student seem wrong? It is okay for them to do that according to the source stated above. On the other hand, a relationship with a student as a male teacher could be portrayed as something so wrong such as rape. It does not look good and that. That is where strategically the issue come in at when you have situations like this. No matter if the teacher is a girl and the teacher is the one pursuing the situation, the male figure in the situation will always get viewed as the antagonist. That is really just the way things go nowadays and of course it is wrong but the male is strategically set to be worse than the female in the situation. It is not even in this situation in a lot of situations the male will look in the wrong before the female.
The public view all student-teacher relationships as a form of rape. As a professional, one should not want to even jeopardize their career with a situation like this but in the case where consent is involved it does not really end the teacher’s career. Whereas in a student-teacher relationship where consent is not involved and it is rape then the teacher’s whole life is thrown away. A teacher could beat a charge of a consensual relationship student that is legally considered “grown”. Over the years, the number of student & teacher relationships have gotten higher but only because a lot of teachers in our generation is young and sexually attractive. At the age of a high school senior, the child is already sexually active so a relationship with his/her teacher would not seem as horrible. A relationship is bound to form between the two no matter if it turn sexual or not. The relationship turning sexual would just be the resulting out of a connection that had developed. “The most recent case occurred in Morris County, where it was discovered that Nicole McDonough, age 32, had sex on numerous occasions with three male students, who were all consenting 18-year old adults; said activities occurred between 2013-2014. She was suspended after her arrest in December on “official misconduct” charges, yet her attorney claims the young adults were treated no differently in the classroom. McDonough faced a prison sentence of up to five years for her alleged crimes of official misconduct.
However, she was granted a three-year PTI or (pre-trial intervention) probationary period.” Which came from a lawyer blog. The co-author of the bill, Assemblyman Raj Mukherji stated that criminalization of these acts is necessary even when a high-school student is 18 or 19 “because a teacher’s supervisory and disciplinary power makes any sexual relationship inherently coercive”. A good bit of people take the stand that the teacher should be allowed to have a relationship with his/her student for various number of reasons. I went to this debate website and they all had the same approach about the situation. One student said, “Seniors in high school should have the privilege to have a relationship with a teacher, current or former. Plus if it really bothers the school or district, have the student take the tests/exams in a different room, somebody else grade them, and record they know the teacher isn't doing anything to abuse power. Standing on what is right and what is wrong is what needs to happen and a relationship with an 18 year old student (legally grown) should be allowed.
