The Notion Of Law & Its Types
“Law is not a Law if it violates the principles of eternal justice” - Lydia Maria Child. Law is a word to describe the rules that usually governments make. The main purpose of law is social order. Orders that we must follow to live in a better society. There are many different types of laws. For example laws for how we live and how we do business. Laws are how we live and how we do business. Laws are everywhere that everyone must follow. If there was no such thing called “Law” this world wouldn’t be where it is now. Our society will be living with fear if there was no such thing called “Law”.
There are many rules that we must obey when it comes to Law. New bills will always be updated by the government. If you don’t obey the rules of the law, you will be paying a fine or be sent to prison. It is good and safe that we have laws that we must obey so that we can live a healthy society. There are many different types of laws, for example: Provincial/Municipal Laws, Federal Law.
Provincial and Municipal law is for divorce, child custody, Real estate, Land, etc. Federal Law is usually for Criminal law, stocks, Bankruptcy, copyright etc. Laws are mainly made from the government and judges that Lawyers and everyone obeys. Charter of Rights are what we follow as Canadians. There are also different types of Lawyers for example, Family Lawyer, Family Children, Domestic Rights, Personal Injury Lawyers, Immigration Lawyer, Criminal Lawyer. Laws can be divided in two ways, public law and Private law.
Public Law is for an individual and the society. If you break the criminal law it is against the society. This means Criminal Law, they deal with crimes and their punishments. Constitutional Law views from the branches of government including federal and provincial governments. It also includes the protection of human rights and fundamental freedoms. Administrative Law deals with the actions and the operations of the government.
Private Law sets rules for individuals. In other words, Civil Law. Private laws make discussions/debates among a group of people and victims. A civil case is action that settles private discussions. There is more Canadian system of law and justice then laws themselves. To understand Canada’s legal system, you need to look at the way the law is applied in practice and what happens to those who violate the law. But first we must examine where “the law” came from?
Let’s just imagine a “community” without laws, obviously that’s not possible but just imagining this gives me goosebumps. What will we see in this place? People misbehaving and doing such things that are usually against the law for instance, murdering people without any punishments, vandalising the community, but for all that blame, escaping and no one speaks up for this since there’s no laws in this community. People who live in such communities, won’t know or can’t decide what is wrong or right. They will go with the flow with the people who do such crimes.
These type of communities, won’t exist for a long time. No laws, no government, no rules, and no community. Moreover Legislation is an essential part of law. Legal codes passed by governments give guaranties to people that all the laws won’t change in different cases. Laws cannot exactly exist without it. If we don’t have written laws, our community stays on the beginning stage of development. That’s exactly why legislation devises my interpretation of law.
Overall, Law is rules that usually governments make that we must obey for all reasons. The main purpose of law is social order, orders that we obey in our country. I’d like to say that law for me means that supporting our community together and having better and stronger relationships with each other, having an equal, healthy community to live with peace and freedom. These should be provided by the government by giving the important and basic laws and people’s strict usage of these laws made by the government. It won’t be any state without these conditions above. Before I end this off, I’ll end it off with an author’s quote about law. “When every man lives without law, every man lives without freedom”.
